The approach

Criminal exposure in employment law falls on individuals: the head of the business, the holder of a delegation of authority, sometimes an operational manager. The first question in a matter of this kind is therefore whether a delegation exists, when it was granted and what it actually covers.

Work is most often preventive: drafting and updating delegations, keeping registers, running internal investigations under conditions that will make them usable. A poorly run internal investigation deprives the business of its main line of defence.
